Subject: Allowing LTC facility for an escort accompanying single handicapped Government servants.

The undersigned, is directed to my that the Staff Side in National Council (JCM) had proposed that additional reimbursement may be allowed to the single-handicapped Government servants for an escort accompanying them on the journeys under the LTC scheme. The Matter has been carefully considered and it has been decided that LTC facility could, be allowed for an escort who accompanies a handicapped Government servant on the journey subject to the following conditions:

1. Prior approval of the Head of the Department concerned is obtained on each occasion.

2. The nature of physical disability of the Government servant is such as to necessitate an escort for the journey. In case of doubt, the decision of the Head of the Department will be final.

3. The physically handicapped Government servant does not have an adult family member.

4. The Government servant and the escort avail of the concession if any, in the rail/bus Fare as might be extended by Railways/ State Roadways authorities in such cases.

5. Any other person who is entitled to LTC does not accompany the handicapped Government servant on the journey.

2. Ministries and Departments are requested to bring the above decision to the notice of all concerned.

Subject: – Facility of LTC by air during winter only to the Government servants posted in Ladakh Region – Regarding

The undersigned is directed to refer to this Department O.M. No. 32011/15/87-Estt.(A) dated 22.4.86 of the subject mentioned above and to say that proposals have been received for allowing facility of air travel to the Government servants posted in Ladakh Region for travel between Leh and Srinagar also. The matter hes beer considered in this Department and it has been decided that this facility may be extended for the journeys between Leh and Srinagar also. Para 1(ii) of the above mentioned O.M. is, therefore, substituted and will read ae under:-

(ii) the facility of air travel will be limited to travel between Leh and Srinagar/ Jammu/ Chandigarh for the forward as well as the return journey. This facility would, however, between be admissible Leh and only one of these three places. The journeys between Srinagar/ Jammu/ Chandigarh and the home-town or any other place of visit, as the case may be, will be regulated by the normal entitlement of the Government servant concerned.”

2. Insofar as the persons serving in the Indian Audit and accounts Department are concerned this issues with the approval of Comptroller and Auditor General of India.

3. Ministry of Agriculture etc. may please bring the above decision to the notice of all authorities having offices in Ladakh region.

Subject: – Admissibility of LTC when both husband and wife are Government servants and are residing together.

The undersigned is directed to say that according to the definition of family as given under SR 2(8), which is applicable, interalia, for the purpose of admissibility of LTC, the family of a Government servant includes wife or husband, as the case may, residing with the Government servant and children residing with and wholly dependent upon the government servant. In addition, it includes the parents, sisters and minor brothers, if residing with and wholly dependant upon the government servant.

2. According to the existing position where both husband and wife are Government servants and are residing together, they constitute one family unit for the purpose of LTC and only one of them can claim this concession and the other spouse travels as a member of, his/her family. ln such a case, the Government servants are required to make a joint declaration of a common home town, which can be the home town of either of the spouses or a third place. Therefore, the spouse, who avails the LTC as member of family of the other could not claim the benefit separately for his/her own parents or dependant minor brothers and sisters even if they were residing with him/her. On the other hand, where the couple both being Govt. servants, are residing separately can claim the benefit of LTC individually for their dependent parents, minor brothers and sisters and also declare two separate places as their respective home towns. Therefore, the husband and wife when both are Government employee and are staying together suffer from certain disadvantages in as much as they have to declare common home town and only one of them can claim the benefit of LTC. The matter has been considered in consultation with Ministry of finance (Department of Expenditure) and it has been decided that where husband and wife both are Government servants, they could, at their option, choose to declare separate home towns and both of them may claim the concession separately under the normal provisions of CCS (LTC) Rules in respect of the members of their respective families subject to the condition that if husband or wife avails the facility as a member of the family of the other, he or she will not be entitled for claiming the concession for self independently. Similarly, the children shall be eligible for the benefit in one particular block as members of the family of one of the parents only. All other conditions for admissibility of the LTC shall continue to be applicable as per normal provisions of the scheme.

3. The above decision will be applicable to the journeys performed for availing the LTC against the block years 1990-1991 onwards.

4. So far as personnel serving in the Indian Audit and Accounts Department are concerned, these orders issue in consultation with the Comptroller and Auditor General of India.

Central Civil Services (Leave Travel Concession) Rules, 1988

1. Short title, commencement and application. –

(1) These rules may be called the Central Civil Services (Leave Travel Concession) Rules, 1988.

(2) They shall come into force on the date of their publication in the Official Gazette.

(3) Subject to the provisions of sub-rule (4), these rules shall apply to all persons –

(i) who are appointed to civil services and posts including civilian Government servants in the Defence Services in connection with the affairs of the Union;

(ii) who are employed under a State Government and who are on deputation with the Central Government;

(iii) who are appointed on contract basis; and

(iv) who are re-employed after their retirement.

(4) These rules shall not apply to –

(a) Government servants not in whole-time employment;

(b) persons in casual and daily rated employment;

(c) persons paid from contingencies;

(d) Railway servants;

(e) members of the Armed Forces;

(f) local recruits in Indian Missions abroad; and

(g) persons eligible to any other form of travel concession available during leave or otherwise.

2. Special provisions regarding certain categories of employees. –

(1) In the case of persons belonging to categories mentioned in clauses (ii), (iii) and (iv) of sub-rule (3) of Rule 1, the leave travel concessions shall be admissible on completion of one year’s continuous service under the Central Government and provided that it is certified by the appropriate administrative authority that the employee concerned is likely to continue to serve under the Central Government for a period of at least two years in the case of Leave Travel Concession to hometown and at least four years in the case of leave travel concession to any place in India to be reckoned from the date of his joining the post under the Central Government.

(2) In the case of officers appointed on contract basis, where the initial contract is for one year but is later extended, the total duration of the contract will be taken into account for the purpose of leave travel concession.

(3) In the case of persons re-employed, immediately after retirement without any break, the period of re-employed service will be treated as continuous with the previous service for the purpose of leave travel concession and the concession allowed for the re-employed period, provided that the leave travel concession would have been admissible to the re-employed officer had he not retired but had continued as serving officer.

Illustration:- If an officer has availed of the concession to visit any place in India in respect of a block of four years before his retirement and he is re-employed without any break, he cannot avail this concession till the expiry of the particular block of four years.

3. Scope. –

The leave travel concession will cover the Government servant himself and his family.

4. Definitions.-

In these Rules, unless the context otherwise requires, –

(a) “a place in India” will cover any place within the territory of India, whether it is on the mainland India or overseas;

(b) “controlling officer” means an officer declared as such under Supplementary Rule 191;

(c) “Disciplinary Authority” shall have the same meaning as assigned in clause (g) of Rule 2 of the Central Civil Services (Classification, Control and Appeal) Rules, 1965;

(d) “Family” means:- see amendment

(i) the Government servant’s wife or husband, as the case may be, and two surviving unmarried children or step children wholly dependent on the Government servant, irrespective of whether they are residing with the Government servant or not;

(ii) married daughters who have been divorced, abandoned or separated from their husbands and widowed daughters and are residing with the Government servant and are wholly dependent on the Government servant;

(iii) parents and/or step mother residing with and wholly dependent on the Government servant;

(iv) unmarried minor brothers as well as unmarried, divorced, abandoned, separated from their husbands or widowed sisters residing with and wholly dependent on the Government servant, provided their parents are either not alive or are themselves wholly dependent on the Government servant.

EXPLANATIONS:

1. The restriction of the concession to only two surviving children or step children shall not be applicable in respect of (i) those employees who already have more than two children prior to the coming into force of this restriction i.e. 20.10.1997; (ii) children born within one year of the coming into force of this restriction; (iii) where the number of children exceeds two as a result of second child birth resulting in multiple births.

2. Not more than one wife is included in the term “Family” for the purpose of these Rules. However, if a Government servant has two legally wedded wives and the second marriage is with the specific permission of the Government, the second wife shall also be included in the definition of “Family”.

3. Though it is not necessary for the spouse and children to reside with the Government servant so as to be eligible for the Leave Travel Concession, the concession in their cases shall, however, be restricted to the actual distance travelled or the distance between the headquarters/place of posting of the Government servant and the hometown/place of visit, whichever is less.

4. Children of divorced, abandoned, separated from their husbands or widowed sisters are not included in the term “Family”.

5. A member of the family whose income from all sources, including pension, temporary increase in pension but excluding dearness relief on pension or stipend etc. does not exceed Rs.1500 p.m. is deemed to be wholly dependent on the Government servant.

(e) “hometown” means the town, village or any other place declared as such by the Government servant and accepted by the controlling officer;

(f) “shortest direct route” shall have the same meaning as given in Supplementary Rule 30 and orders issued thereunder from time to time.

5. Change of Hometown.-

The hometown once declared and accepted by the controlling officer shall be treated as final. In exceptional circumstances, the Head of the Department or if the Government servant himself is the Head of the Department, the Administrative Ministry, may authorise a change in such declaration provided that such a change shall not be made more than once during the service of a Government servant.

6. Declaration of place of visit under Leave Travel Concession to any place in India.-

When the concession to visit any place in India is proposed to be availed of by a Government servant or any member of the family of such Government servant, the intended place of visit shall be declared by the Government servant in advance to his controlling officer. The declared place of visit may be changed before the commencement of the journey with the approval of his controlling officer but it may not be changed after the commencement of the journey except in exceptional circumstances where it is established that the request for change could not be made before the commencement of the journey owing to circumstances beyond the control of the Govt. servant. This relaxation may be made by the Administrative Ministry/Department or by the Head of the Department, as the case may be.

7. Admissibility of Leave Travel Concession.-

(1) The leave travel concession shall be admissible to persons of the categories specified in clauses (i) and (iii) of sub-rule (3) of Rule 1 only, if they have completed one year’s continuous service under the Central Government on the date of journey performed by him or his family, as the case may be, to avail of the concession.

(2) The leave travel concession shall be admissible during any period of leave, including casual leave and special casual leave.

8. Types of leave travel concession.- see amendment

(a) The leave travel concession to hometown shall be admissible irrespective of the distance between the headquarters of the Government servant and his hometown, once in a block of two calendar years, such as 1986-87, 1988-89 and so on.

(b) the leave travel concession to any place in India shall be admissible irrespective of the distance of the place of visit from the headquarters of the Government servant, once in a block of four calendar years, such as 1986-89, 1990-93 and so on:

Provided that in the case of a Government servant to whom leave travel concession to hometown is admissible, the leave travel concession to any place in India availed of by him shall be in lieu of, and adjusted against, the leave travel concession to hometown available to him at the time of commencement of the journey;

(c) A Government servant whose family lives away from him at his hometown may, in lieu of all concessions under this scheme, including the leave travel concession to visit any place in India once in a block of four years which would otherwise be admissible to him and members of his family, choose to avail of leave travel concession for self only to visit the hometown every year.

9. Counting of leave travel concession against particular blocks.-

A Government servant and members of his family availing of leave travel concession may travel in different groups at different times during a block of two of four years, as the case may be. The concession so availed of will be counted against the block of two years or four years within which the outward journey commenced, even if the return journey was performed after the expiry of the block of two years or four years. This will apply to availing of leave travel concession carried forward in terms of Rule 10.

10. Carry over of leave travel concession.-

A Government servant who is unable to avail of the leave travel concession within a particular block of two years or four years may avail of the same within the first year of the next block of two years or four years. If a Government servant is entitled to leave travel concession to home town, he can carry forward the leave travel concession to any place in India for a block of four years only if he has carried forward the leave travel concession to home town in respect of the second block of two years within the block of four years.

11. Place to be visited by Government servant and members of his family under leave travel concession to any place in India.-

A Government servant and each member of his family may visit different places of their choice during a block of four years. It shall not be necessary for members of family of a Government servant to visit the same place as that visited by the Government servant himself at any time earlier during the same block.

12. Entitlement.– see amendment see new rates

(1) For travel under the Scheme of Leave Travel Concession the entitlement shall be as under –

(A) Journey by Air/Rail:

Pay Range Entitlement
Rs.18,400 and above. Air Economy (Y) Class by National Carriers or AC First Class by train, at their option.
Rs.16,400 and above, but less than Rs.18,400 AC First Class.
Rs.8,000 and above, but less than Rs.16,400. Second AC-2 tier Sleeper.
Rs.4,100 and above, but less than Rs.8,000. First Class/AC 3-tier Sleeper/AC Chair Car.*
Below Rs.4,100. Second Sleeper.

*All Govt. servants who are entitled to travel on LTC by First Class/AC 3-tier Sleeper/AC Chair Car may, at their discretion, travel by AC 2-tier Sleeper in cases where any of the trains connecting the originating and destination stations concerned by the direct shortest route do not provide these three classes of accommodation.

Travel by Rajdhani Express Trains:

Pay Range Entitlement
Rs. 16,400 and above. AC First Class.
Rs.8,000 and above, but less than Rs.16,400. Second AC 2-tier Sleeper.
Rs.4,100 and above, but less than Rs.8,000. Chair Car/AC 3-tier Sleeper.

Travel by Shatabdi Express Trains:

Pay Range Entitlement
Rs. 16,400 and above. Executive Class.
Rs.4,100 and above, but less than Rs.16,400. AC Chair Car.

Note.- Entitlement by Rajdhani/Shatabdi Trains would be applicable in cases where journey is actually undertaken by these trains and not for determining entitlement on notional basis. Both ends of the journey, i.e., place of start of the journey and the destination should be directly connected by Rajdhani/Shatabdi Express.

(B) Journey by Sea or by River Steamer:

Pay Range Entitlement
Rs.8,000 and above. Highest Class.
Rs.6,500 and above, but less than Rs.8,000 If there are two classes only on the steamer, the lower class.
Rs.4,100 and above, but less than Rs.6,500. If there are three classes, the middle or the second class. If there are four classes, the third class
Below Rs.4,100. The lowest class.

Accommodation entitlements for travel between the mainland and the Andaman & Nicobar Group of Islands and the Lakshadweep Group of Islands by ships operated by the Shipping Corporation of India Limited will be as follows:-

Rs.6,500 and above, but less than Rs.8,000 First/`A’ Cabin Class.
Rs.4,100 and above, but less than Rs.6,500. Second/`B’ Cabin Class.
Below Rs.4,100. Bunk class.

(C) Journey by Road:

Pay Range Entitlement
(i) Rs. 18,400 and above. Actual fare by any type of public bus, including air-conditioned Bus:
OR
At prescribed rates for AC Taxi/Taxi (AC Taxi when the journey is actually performed by AC Taxi) for journey to the places not connected by rail, subject to condition that the claim shall be restricted to the bus fare by entitled class or the fare actually paid, whichever is less.
(ii) Rs.8,000 and above but less than Rs.18,400. Same as at (i) above with the exception that journeys by AC Taxi will not be permissible.
(iii) Rs.6,500 and above, but less than Rs.8,000. Same as at (ii) above with the exception that journeys by AC Bus will not be permissible.
(iv) Rs.4,100 and above, but less than Rs.6,500. Actual fare by any type of public bus other than air-conditioned Bus:
OR
At prescribed rates for Auto rickshaw for journey to places not connected by rail, subject to condition that the claim shall be restricted to the bus fare by entitled class or the fare actually paid, whichever is less.
(v) Below Rs.4,100. As at (iv) above with the condition that the claim shall be restricted to the bus fare by ordinary bus.

NOTE.- In all cases of travel by AC Taxi, Taxi or Auto-rickshaw production of fare receipt will be necessary.

(2) Journey by road.-

(i) Where a public transport system as aforesaid does not exist, the assistance will be regulated as in case of journeys undertaken on transfer.

(ii) Notwithstanding anything contained in sub-rule (1) or Clauses (i) and (ii) of sub-rule (2), where a Govt. servant travelling by road takes a seat or seats in a bus, van or other vehicle operated by Tourism Development Corporations in the Public Sector, State Transport Corporations and Transport services run by other Government or local bodies to visit any place in India, the reimbursement shall be either the actual hire charges or the amount reimbursable on the journey to the declared place of visit had the journey been undertaken by entitled class by rail by the shortest direct route, whichever is less. Reimbursement shall not be admissible for journey by a private car (owned, borrowed or hired), or a bus, van or other vehicle owned by private operators.

(3) By Air.- The Govt. servant may travel by air between places not connected by rail, where an alternative means of travel is either not available or is more expensive.

(4) In regard to places in territory of India connected by shipping services, the entitlement of a Govt. servant to travel by ship will be regulated as in the case of journeys by ship undertaken on transfer.

(5) Travel between places not connected by any other means of transport.- For travel between places not connected by any other means of transport, a Govt. servant can avail of animal transport like pony, elephant, camel, etc. In such cases mileage allowance will be admissible at the same rate as for journeys on transfer.

EXPLANATION.- For the purpose of this Rule, “Pay” shall mean pay as defined in FR 9 (21) (a) (I). [Now Basic pay + NPA+SI-vide GID (1) below SR 17 and OM, dated 7.6.1990.]

13. Reimbursement.-

Reimbursement under the leave travel concession scheme shall not cover incidental expenses and expenditure incurred on local journeys. Reimbursement for expenses of journey shall be allowed only on the basis of a point to point journey on a through ticket over the shortest direct route.

14. Forfeiture of claim.-

A claim for reimbursement of expenditure incurred on journey under leave travel concession shall be submitted within three months after the completion of the return journey, if no advance had been drawn. Failure to do so will entail forfeiture of the claim and no relaxation shall be permissible in this regard.

15. Grant of advance and adjustment thereof.-

(i) Advance may be granted to Government servants to enable them to avail themselves of the concession. The amount of such advance in each case shall be limited to four-fifths of the estimated amount, which Government would have to reimburse in respect of the cost of the journey both ways.

(ii) If the family travels separately from the Government servant, the advance may also be drawn separately to the extent admissible.

(iii) The advance may be drawn both for the forward and return journeys at the time of commencement of the forward journey, provided the period of leave taken by the Government servant or the period of anticipated absence of the members of the family does not exceed three months or ninety days. If this limit is exceeded, then the advance may be drawn for the outward journey only.

(iv) If the limit of 3 months or ninety days is exceeded after the advance had already been drawn for both the journeys, one half of the advance should be refunded to the Government forthwith.

(v) The advance should be refunded in full if the outward journey is not commenced within 30 days of the grant of advance. However, in cases where reservations can be made sixty days before the proposed date of the outward journey and advance is granted accordingly, the Government servant should produce the tickets within ten days of the drawal of advance, irrespective of the date of commencement of the journey.

(vi) Where an advance has been drawn by a Government servant, the claim for reimbursement of the expenditure incurred on the journey shall be submitted within one month of the completion of the return journey. On a Government servant’s failure to do so, he shall be required to refund the entire amount of advance forthwith in one lump sum. No request for recovery of the advance in instalments shall be entertained.

16. Fraudulent claim of leave travel concession.-

(1) If a decision is taken by the Disciplinary Authority to initiate disciplinary proceedings against a Government servant on the charge of preferring a fraudulent claim of leave travel concession, such Government servant shall not be allowed the leave travel concession till the finalisation of such disciplinary proceedings.

(2) If the disciplinary proceedings result in imposition of any of the penalties specified in Rule 11 of the Central Civil Services (Classification, Control and Appeal) Rules, 1965, the Government servant shall not be allowed the next two sets of the leave travel concession in addition to the sets already withheld during the pendancy of the disciplinary proceedings. For reasons to be recorded in writing, the controlling authority can also disallow more than two sets of leave travel concession.

(3) If the Government servant is fully exonerated of the charge of fraudulent claim of leave travel concession, he shall be allowed to avail of the concession withheld earlier as additional set (s) in future block years but before the normal date of his superannuation.

EXPLANATION.- For the purpose of this rule, leave travel concession to hometown and leave travel concession to any place in India as specified in clauses (a) and (b) of Rule 8 shall constitute two sets of the leave travel concession.

17. Interpretation.-

If there is any doubt regarding any of the provisions in these rules, the matter shall be referred to the Government of India in the Department of Personnel and Training, who shall decide the same.

18. Power to relax.-

Save as otherwise provided in these rules, where any Ministry or Department of the Government is satisfied that the operation of any of these rules causes undue hardship in any particular case, that Ministry or Department, as the case may be, may, by order, for reasons to be recorded in writing, dispense with or relax the requirements of that rule to such extent and subject to such exception and conditions as it may consider necessary for dealing with the case in a just and equitable manner:

Provided that no such order shall be made except with the concurrence of the Department of Personnel and Training.

19. Saving.-

All the existing instructions which are not contrary to any of the provisions of these rules and all instructions which cover matters not specifically covered by these rules, shall continue to be in force until they are amended, modified or cancelled.

OFFICE MEMORANDUM

Subject: Below Benchmark grading in ACRs prior to reporting period 2008-09 – Empanelment cases.

Reference is invited to this Department 0.M. No.21011/1/2010-Est(A) dated 13.04.2010, vide which decision of the Government was conveyed that if an employee is to be considered for promotion in a future DPC and his ACR prior to the period 2008-09, which would be recknonable for assessment of his fitness in such future DPCs, contain final grading which are below the benchmark for, his next promotion, the concerned employee will be given a copy of the relevant. ACR for his representation, if any, before such ACRs are placed before the DPC. Subsequently, vide D.M. of even number dated 22.05,2014, it was further clarified that in cases where benchmark at one level varies from a benchmark at another level ;post and where the ACRs prior to the period 2008-09 are also reckonable for assessment of his fitness in any DPC subsequent to the next promotion (including any empanelment/financial upgradation), a copy of the ACR shall be given to the officer concerned, for representation, if any.

2. The matter has been considered in this Department with reference to empanelment for holding posts at the level of Joint Secretary/Additional Secretary/Secretary under Central Staffing Scheme (CSS). The process of empanelment under CSS and the process of empanelment for promotion in the cadre, are distinct. Unlike promotion in the cadre, where a fixed benchmark is prescribed, empanelment for holding posts under CSS is done on the basis of evaluation of ,ACRs/APARs, overall service record, vigilance status of officers and Multi-source Feedback from relevant stakeholders etc. as per the extant, guidelines in this regard. There is no pre-determined benchmark, as such, for empanelment under CSS.

3. It is, therefore, clarified that the provisions of DoP&Ti’s D.M. No.21011/01/2010-Estt(A) dated 13.04.2010 are not applicable to empanelment for holding Joint Secretary/Additional Secretary/Secretary level posts under the Central Staffing Scheme. The word ’empanelment’ appearing in Para 2(c) of D.M. No.21011/01/2010-Estt(A) dated 22.05.2014 implies empanelment for promotion to a cadre post and not empanelment for holding a post under the Central Staffing Scheme.

Ref: DoP&T’s OM No. 25013/3/2019-Estt.A-IV dated 20.06.2019 (Copy enclosed).

Please refer to Board’s letter of even number dated 10.11.2015 on the cited subject, wherein instructions were issued to review the performance of Railway servants periodically to ascertain whether the Railway servant should be retained in service or retired from service in the public interest. In this regard, kindly also connect letter No. E(0)1/2017/SR-10-P/03 dated 11.06.2019 from Secretary, Railway Board vide letter No., reiterating Board’s earlier instructions dated 10.11.2015. Recently, DoP&T’s OM dated 20.06.2019 has been received which is enclosed.

2. In accordance with DoP&T’s instructions dated 20.06.2019, all Zonal Railways/PUs are requested to undertake periodic review of Railway servants under rules 1802 (a)/1803 (a)11804 (a) – R.II in letter and spirit for strengthening of administration. It should be ensured that the prescribed procedure like forming of opinion to retire a Railway employee prematurely in public interest is strictly adhered to. and that the decision is not an arbitrary one, and is not based on collateral grounds as per the order of the Hon’ble Supreme Court in case of U01 & Col. J.N. Sinha [1571 SCR (1) 791].

3. All the Zonal Railways/ PL’s shall furnish a report to Board’s office in the format given below by the 8th day of each month starting from July. 2019. The above format is also being made part of monthly PCDO sent to MS/ Railway Board.

In pursuance of Ministry of Finance (Deptt. Of Expenditure) OM no. 2/5/2017- E.IIB, dated 05.03.2019 (copy enclosed) and in supersession of this Directorate’s OM number 12034 / 1/ 2007-Pol.III dated 14.11.2007, it has been decided that the conditions of applying for Government accommodation and furnishing of ‘No Accommodation Certificate (NAC)’ by Central Government employees, to become eligible for House Rent Allowance, are dispensed with for all places in the country, in respect of General Pool Residential Accommodation (GPRA) under the control by Directorate of Estates, Ministry of Housing & Urban Affairs. Central Government employees will thus be eligible to draw HRA, lf they have not availed the facility of Government accommodation and for this they will not have to produce NAC.

2. These order shall be effective from 05.03.2019.

Subject:- Regularisation of allotment on re-transfer to the last place of posting.

It has come to the notice of this Directorate that some allottees of General Pool Residential Accommodation (GPRA) have retained their accommodation at their last place of posting in contravention of the extant guidelines and instructions on the subject. In this regard, reference is invited to the Rule 54 of Central Government General Pool Residential Accommodation Rules, 2017(CGGPRA Rules, 2017) and it is reiterated that the allottees who have retained General Pool Residential Accommodation (GPRA) at their last place of posting due to their transfer/ posting at non-family stations in violation of the provision of the CGGPRA Rules, 2017 or the extant guidelines, shall not be considered for regularisation of GPRA at their last place of posting.

Reference is invited to the O.M of even Number dated 10.4.2018 of Directorate of Estates regarding retention of General Pool Residential Accommodation by Central Government Civilian Employees (including CAPF employees), Officers of All India Services posted in Non- family stations and to clarify that following points shall be taken in care before giving such concessional retentions: –

i. Employees transferred before 19.6.2017

Retention shall be given for entire period of transfer or till 30.6.2018 whichever is earlier, at the first instance. After that retention shall be given till the date of completion of their period of transfer or 3 years (i.e 18.6.2020) whichever is earlier.

ii. Employees transferred on or after 19.6.2017

Retention shall be given for a maximum period of 3 years from the date of transfer or till 30.6.2021, whichever is earlier.

2. Such retention shall be given on following general conditions: –

a. Such retention shall be given only on online request of the allottee duly forwarded
by their administrative authority and on production of half yearly bonafide certificate.

b. In any case retention shall not be granted beyond 30.6.2021.

c. The retention is to be granted on existing terms and conditions.

d. Such concessional retention shall be subject to the clearance of outstanding dues, if any.

3. It is requested to all concerned officers to strictly adhere to these instructions.

Reference is invited to the Directorate of Estates O.M.No.12035/31/96- Pol.lI dated 7.9.1998 and subsequent instructions dated 30.9.1999, 30.4.2002, 15.7.2005, 1.7.2008, 3.6.2011, 9.7.2014 and 7.4.2015 regarding concessional retention of General Pool Residential Accommodation at the last place of posting by Central Government Civilian Employees and Officers of An India Services on posting to the States in the North Eastern Region, Sikkim, Andaman & Nicobar Islands and Lakshadweep and O.M.No.12035/2/90 Pol.II(Pt.II) dated 15.9.1998 and subsequent instructions dated 26.7.1999, 25.5.2002, 31.10.2005, 5.6.2008, 3.6.2011, 9.7.2014 and 7.4.2015 regarding retention of General Pool Residential Accommodation at the last place of posting by Central Government Civilian Employees and Officers of All India Services on posting to the State of Jammu & Kashmir. The existing instructions on the subject are valid up to 30.6.2018. It has now been decided to further extend the concessional retention of General Pool Residential Accommodation at the last place of posting by Central Government Civilian Employees (including CAPF employees), Officers of All India Services on their posting to a Non-family stations for a further period of three years i.e, upto 30.06.2021 on payment of normal rate of licence fee. The concession of retention of GPRA would also be admissible if a Government servant is transferred from one place to another within the Non-family stations.

2. Only those CAPF Personnel’s who are working and posted in headquarters are eligible for such concessional retention,

3. It is clarified that the facility of concessional retention of GPRA at the last place of posting for Central Government Civilian Employees (including CAPF employees), and Officers of All India Services is permitted only when the allottee of GPRA is transferred to Non-Family stations from other places and is not permitted to the Central government employees who are repatriated back to his/her parent office in Non-family stations on completion of their deputation from other places .

4. Since the retention of Government accommodation is allowed for bonafide use of the dependent family of the transferred Government servant, he/she will furnish a certificate on 1st July and 1st January of every year, stating that his/her dependent family members are actually residing in the Government accommodation at the last place of posting. Such a certificate will also have to be furnished at the time of seeking retention. In case, no such certificate is received by 31st January and 31st July of every year, the Directorate of Estates will be constrained to cancel the allotment/retention of the residence.

5. The hard copy of online application duly filled by applicant by logging in the portal of the Directorate of Estates (www.gpra.nic.in) duly forwarded by the office where the officer joined on posting ill the above mentioned areas, for retention of general pool residential accommodation should be received in the Directorate of Estates within a period of one month from the date of relinquishing the charge at the last place of posting, so that, further necessary action could be initiated by the Directorate.

ln compliance of the directions of Hon’ble High Court of Delhi dated 13.11.2017 in W.P. (C) No. 4042/2017, 4290/2017, 4318/2017, 4485/2017 & 5962/2017, a Comprehensive Policy for allotment of quarters was submitted before Hon’ble Court. Hon’ble Court approved the Policy vide its order dated 20.02.2018. A copy of Comprehensive Policy is annexed. The Policy appropriately modifies the Directorate of Estates’ O.M. No. DOE/RDV/A-Il (Coord)/ 2016-Main dated 12.04.2017 & 26.04.2017.

Subject: Clarification on Rule 10 of the Central Government General Pool Residential Accommodation Rules, 2017 -reg.

Reference is invited to Rule 10(1) of the Central Government General Pool Residential Accommodation Rules, 2017 notified vide G.S.R. 598(E)(copy enclosed). The guidelines /instructions issued vide above referred GPRA Rules, 2017 state that “no application shall be entertained for accommodation within six months of the date of superannuation”. lt may be interpreted from the rule that no application shall be processed and, consequently, allotment of accommodation made within the period of six months prior to date of superannuation.

Reference is invited to the O.M. of even number dated 14.11.2017 regarding retention granted to allottees (including AGMUT cadre officers) of GPRA at their last place of posting in case of their posting to different non-family stations for bonafide use of their family members.

2. It is to inform that the para 2 of the above O.M should be read as “It may further be stated that w.e.f 19.06.2017, after the introduction of new rules i.e CGGPRA Rules, 2017, further retention should be granted to such allottees unto 30.06.2018 or maximum of 3 years, whichever is earlier.”

Sub: The Central Government General Pool Residential Accommodation Rules, 2017.

Reference is invited to the O.M of even Number dated 22.6.2017, vide which Central Government General Pool Residential Accommodation Rules, 2017 were circulated throughout country. It has been observed that some provisions of Old Rules i.e Allotment of Government Residences (General Pool in Delhi), Rules 1963 and Garage Rules, 1964 are still used by concerned authorities.

2. In this regard, a change statement stating major changes made in new allotment rules vis-a-vis old rules has been prepared and forwarded herewith for adherence.

Subject: Procedure to be followed in cases of disagreement on Recruitment Rules – regarding.

The undersigned is directed to state that as per extant instructions, the process of framing/amending of Recruitment Rules for a post involves consultation with DoPT, UPSC and thereafter vetting by the Legislative Department. As per established procedure, the Administrative Ministries/Departments frame service rules/recruitment rules or propose amendments thereof, based mainly on the model RRs or instructions issued by DoPT from time to time and refer them to DoP&T for concurrence. After the receipt of concurrence from DoPT, the Ministries/Departments refer proposals to UPSC for advice. After receipt of concurrence of UPSC, with the approval of Competent Authority, RRs are finally notified, after vetting by the legislative Department.

2. UPSC brought certain instances to the notice of this Department, where post the advice of Commission, RRs have been notified incorporating substantial changes in the recruitment rules/service rules (RRs/SRs). without obtaining the concurrence of the Commission, which is not in order. On consideration of the matter, it has been decided that if substantial changes are effected in the RRs after the receipt of advice of UPSC, the same shall be brought to the notice of UPSC by the administrative Ministry for obtaining their advice/concurrence on the same. Non-adherence to this procedure may result in the case being treated as a case of disagreement with the Commission, and therefore administrative Ministries have to take a conscious decision in this regard. Substantial changes referred here are those changes having a bearing on the principles of recruitment, viz., change in the method of recruitment, eligibility criteria etc and does not include vetting changes made by the Legislative Department, spelling or grammatical corrections.

3. In light of the foregoing, all Ministries/Departments are requested to refer the proposals back to UPSC for concurrence in cases where administrative Ministry/Department, after the receipt of advice of the Commission, want to carry out any change/s in the draft RRs/SRs, which is/are substantial in nature. All Ministries/Departments are requested to adhere to these instructions.

Subject: – Abolition of Rent Free Accommodation Allowance Recommendation of the Seventh Central Pay Commission.

Based upon the recommendation of the Committee of Allowances formed under the aegis of the Seventh Pay Commission vide Para 7 of the Resolution No. 1-2/2016-lC dated 25th July, 2016, Government of lndia has inter alia decided that Rent Free Accommodation Allowance stands abolished with effect from 1st July, 2017 vide Resolution No, 11-1/2016 lC dated 6th July, 2017.

2. This order shall apply to all rent free accommodations allotted to Government employees under General Pool Residential Accommodation. DDOs of all concerned Ministries and Departments are hereby advised to take necessary action at their end.

3. This issues with the approval of the competent authority.

Subject: Attachment of garages with nearby/adjacent Govt. quarter in Type VA and Type VB.

As per Rule 20 of the Central Government General Pool Residential Accommodation Rules, 2017 an allottee of Types V A[D-II] and V B[D-I] may apply for allotment of a garage in case he/she owns a car. The deemed date of application for allotment of garage shall be the date of technical occupation of initial allotment of accommodation by the allottee for the locality.

2. It has been observed that the ground floor allottees are beneficiary of extra space that is provided in ground floor quarters and it can be easily used for parking of vehicle. The same is not available to upper floor allottees. Also, there is difference in date of priorities of ground floor and upper floor allottees due to which upper floor allottees may not get chance for allotment of garage in comparison to ground floor allottees.

3. The matter has been reviewed and it has now been decided by the competent authority that the garages available in Govt. colonies shall be attached to nearby/adjacent quarter, so that quarter and garages may be considered as one unit while allotment of garage through ASA. Therefore, based on the data available in GAMS and information received through CPWD Centers of listed Type VA and Type VB colonies, garages are being attached to nearby/adjacent Govt. quarter as per the annexures.

4. Practically, the attachment will be done in a phased manner as follows: –

(i) Firstly, the quarters already attached with adjacent garages and matching the proposed attachment of Directorate of Estates, will be attached as per this proposal by concerned allotment Sections.

(ii) Secondly, in such cases where two garages are proposed to be attached to such two quarters which were earlier attached to the opposite garages, mutual exchange between garages will be required. This will be done by concerned allotment sections with the consent of the current allottees.

(iii) Thirdly, if the allottee is not in position to vacate the garage at this point of time, the garage will be attached / declared unattached (as per this proposal) on vacation of GPRA by the present allottee.

5. Therefore, the concerned allotment Sections are requested to take further necessary action accordingly.

G.S.R. 598(E).-In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Allotment of Government Residences (General Pool in Delhi) Rules, 1963 and the Garage Rules, 1964 except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the allotment of accommodation to Central Government employees at various places of the country under the control of the Directorate of Estates, Ministry of Urban Development, namely:-

PART I

GENERAL

1. Short title and commencement.-

(1) These rules may be called the Central Government General Pool Residential Accommodation Rules, 2017.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.-

In these rules, unless the context otherwise requires,-

(a) “accommodation” means the General Pool Residential Accommodation (GPRA) of the Central Government under the control of the Directorate of Estates;

(b) “allotment” means the grant of a licence to occupy a residential accommodation in accordance with the provisions of these rules and include allotment by Automated System of Allotment (ASA) or by manual system of allotment;

(c) “allotment of garage” means the grant of a licence to occupy a garage in accordance with the provisions of these rules;

(d) “damages” means a compensation to be levied in multiples of licence fee in the event of unauthorised occupation or subletting or misuse of whole or any part of accommodation or garages by the occupant of the accommodation or garages;

(e) “Delhi” means the area within the limits of the National Capital Territory of Delhi which the Government may declare conferring eligibility for the allotment of accommodation;

(f) “Directorate of Estates” means Office of the Directorate of Estates and Estates Offices under the Central Public Works Department, which discharge the functions of the Directorate of Estates in respect of accommodation;

(g) “Director of Estates” means the Directors of Estates to the Government of India and includes an Additional, Deputy Directors of Estates and Assistant Directors of Estates in the Directorate of Estates;

(h) “eligible type of accommodation” in relation to an officer means the type of accommodation to which he is eligible under these rules;

(i) “eligible office” means an Office the staff of which has been declared by the Central Government as eligible for accommodation under these rules;

U) “employee” means an employee of the Central Government whose salary is drawn from the Consolidated fund of India;

(k) “family” means the wife or husband of allottee, as the case may be, and children, step children, legally adopted children, parents, brothers or sisters as ordinarily reside with and are dependent on the allottee;

(1) “Government” means the Central Government unless the context otherwise requires;

(m) “guest” means a casual visitor staying temporarily with the allottee;

(n) “own house” means a building or part thereof meant for residential purposes and owned by the allottee or by any member of his family;
